My client in 2018 claim his kids and his girlfriends(mother of his kids).In 2019 My client claim the kids without the girlfriend. In 2020 he would like to claim kids and the mother of the kids, but she already received the 3erd stimulus check. If I file client's taxes with the Girlfriends, she should return the 3erd stimulus check?
I read IRS web " Generally, anyone who is a US Citizen, or U.S. resident alien is eligible. You will get the full amount of the 3erd Economic impact payment if you (and your spouse if filing a joint return) are not a dependent of another, have a valid social security number....SO, most tax preparer said that everybody will received the stimulus check, I'm confused. Thank you!
2018 or 2019 has nothing to do with anything now.
The 2020 tax return is the reconciliation of what they are entitled to, based on 2020, to what they got.
The Third payment has nothing to do with 2020 taxes.
You should read the IRS guidance for 2020, since you are preparing 2020 tax returns.
Perhaps it would help to review what is really happening:
The funds were paid out as Advanced payment against a projection. The projection used 2018 or 2019 tax returns. But 2020 is the Actuals. You use the 2020 return to reconcile what a person is entitled to, against what they got.
If the person is not a dependent in 2020, then they would be entitled to the payment/credit as individual filers. That doesn't mean "not being claimed." It means "no longer qualifies as a dependent."
