I think what the legislature / governor "intended" is to find as many ways as they could to avoid the education surcharge that was passed by Prop 208.  By creating the SBI (along with two other bills), they were hoping that at least one of them would "stick".  But it was all back room negotiations, so who knows whether they actually thought through the implications.
