Starting a new thread since I can't post follows on the original topic here:

However I can't find this anywhere on the IRS page. @TaxGuyBill is this still a valid link? I ask because I came across this page on the IRS website: https://www.irs.gov/businesses/small-businesses-self-employed/do-you-need-a-new-ein

 

It doesn't seem to reference the quote you had provided from the original link. It doesn't reference anything related to MMLLC to SMLLC. The only reference I see it about Partnerships and it says that if one partner takes over and starts operating as a sole proprietor the one needs a new EIN.

This site seems to state that no new EIN is required when moving from MMLLC to SMLLC: https://www.llcuniversity.com/irs/ein-responsible-party-for-llc/

 

In my case it was a MMLLC with a S-Corp election. Then it changed to a SMLLC (taxed as a sole proprietor) and the S-Corp election was withdrawn. So I'm trying to figure out 2 things:

 

1. Do I need a new EIN?

2. How should I fill out a W-9 without invalidating my LLC protections. Should I use my LLC name with EIN, my name with EIN or my name with SSN?
