If return has other dependent creidt and user of PS is nonpaid preparer or is self-prepared, why does diagnostic say Form 8867 is required?

Will the return be e-filed successfully if diagnostic says Form 8867 is required, but technically is not required since return is non-paid preparer or is self-prepared?

You can try it and see.  You may want to disable error checking though.

There have been a lot of errors with selecting non-paid preparer and self-prepared this year, so many of us just 'break the rules' and just say it is a paid preparer.

Appreciate your answer.  Why would you want to disable error checking?  I thought error checking was supposed to point out things that may cause an e-file rejection?
Not sure if I want to try to e-file with the diagnostic error...and then to get the e-file rejected.  Maybe will just change to say "paid preparer".
