My client is deceased and has a Form 1310 as part of his return. Person claiming small refund is not surviving spouse. Can I still efile this tax return.

Doesn't it depend on which boxes on the 1310 you check?  I thought if you checked box B you have to paper file with a certificate of appointment (in VA it's called Letter of Qualification)?

Yes.  In Ohio it's called Entry Appointing Fiduciary
