Can an llc filing as a SCORP file a 1099? I know they should file a w-2 but do they have to?

Yes, they have to file W-2s.  It's pretty hard to say someone is an independent contractor when they are in effect working for themselves.  Time to file late payroll tax returns and make those payroll tax payments ………………. and then be ready for the penalties.  People really need to sit down with a professional before they start these hair brained journeys rather than after.
