When you mark a Texas franchise tax return as final, Form 05-102 and Form 05-167 won't generate with the return. Per the Texas Comptroller, these forms are only listed as Annual, not Annual/Final. If this isn't a final return, but was marked final by mistake, click on your return type below to view steps to generate the form.
Corporate (1120)
- From the left of the screen, select General and choose Miscellaneous Information.
- From the top of the screen, select Miscellaneous.
- Remove the 2 or 3 in the 1=initial return, 2=final return, 3=both field.
- From the left of the screen, select State & Local and choose Other forms.
- Select TX Franchise Tax.
- Scroll down to the Initial/Final Reports subsection.
- Remove the 2 in the Type of report: blank=annual, 1=initial, 2=final field.
Individual (1040)
- From the left of the screen, select State & Local and choose Taxes.
- Select Texas Franchise Tax.
- Scroll down to the Initial/Final Reports subsection.
- Remove the 2 in Type of report: blank=annual, 1=initial, 2=final.
S-Corporate (1120-S)
- From the left of the screen, select General and choose Miscellaneous Information.
- From the top of the screen, select Miscellaneous.
- Scroll down to the Final Return subsection.
- Check the box labeled Final return.
- From the left of the screen, select State & Local and choose Other Forms.
- Select TX Franchise Tax.
- Scroll down to the Initial/Final Reports subsection.
- Remove the 2 in Type of report: blank=annual, 1=initial, 2=final.
Partnership (1065)
- From the left of the screen, select General and choose Miscellaneous Information.
- From the top of the screen, select Miscellaneous.
- Scroll down to the Final Return subsection.
- Check the box labeled Final return.
- From the left of the screen, select State & Local and choose Other Forms.
- Select TX Franchise Tax.
- Scroll down to the Initial/Final Reports subsection.
- Remove the 2 in Type of report: blank=annual, 1=initial, 2=final.
