An adult child age 28 lives with his parents. The parents income is too high to qualify for EIC. The child's income is low enough to qualify for EIC. It used to be if more than one person in a household it went to the one with the higher income. I have read and read and can't seem to find anything concrete on this. Anyone else have this situation or know for sure?

If the 28 year old makes too much to be a dependent of the parents then they would qualify for EIC.

He does. His income was over $10k. I was worried about him being in the same household as his parents. I believe I remember that rule was changed several years ago but haven’t had anyone with this situation. I couldn’t find where it would go to the higher income even if they didn’t qualify. Thank you for helping me out.
